Featured Decision: Court Upholds Drug and Alcohol Restrictions for Theft Offender
The Supreme Court of Ohio's decision allowing a trial judge to prohibit a Geauga County woman from using drugs or alcohol and from entering bars as part of her sentence for misdemeanor theft is the latest “Featured Decision” video.
In a unanimous decision, the Supreme Court reversed an appeals court ruling, which found the trial court could not impose the restriction on Susan Ballish because the use of drugs or alcohol played no role in her theft offense. Ballish objected to the drug and alcohol conditions placed on her in 2023, arguing that under a previous Supreme Court decision, a condition of probation not “reasonably related” to the committed offense is prohibited. The Court explained how Ballish’s case differed from the prior Court ruling, and why it was justified as part of her sentence.
