Featured Decision: Submetering Company Can Be Regulated as Public Utility

The Supreme Court of Ohio’s decision finding that a submetering company is subject to state regulation is the latest Featured Decision video.
In a unanimous decision, the Supreme Court found that the Public Utilities Commission of Ohio (PUCO) can regulate Nationwide Energy Partners, a submetering company. The Court stated that while originally a way for landlords to divide utility charges among tenants, submetering today is a big business whereby third-party companies “buy gas, electric, and other services from a public utility and then resell those services to the ultimate consumer.”
The Court explained why state law allows the PUCO to regulate submetering companies.
